災害行方不明者の死亡認定（工場長こと古家寛）

一定期間、生死が不明の場合、その方は亡くなったものとみなされます。
期間は、普通失踪（原因のない通常の失踪）の場合は7年、
特別失踪（災害や船舶の沈没など特別な危難での失踪）の場合は1年です。
今回の東日本大震災の場合、行方不明者が1万4129人（4月17日現在）おり、
この方々の場合は民法上の特別失踪に当たります。

上記の規定にあてはめて考えれば、
生死不明の方を亡くなったとみなして法的な状況を確定するまでに1年間が必要です。
しかし今回、政府がその規定を特別に3ヵ月に短縮する方針を固めたようです。

被害の大きさを考慮し、遺族の生活再建を支援するためにも、
遺族年金などの支給を早められるようにとの配慮のようです。
ちなみに阪神大震災の時には、この様な特別処置は行われませんでした。
最終的な行方不明者が3名で、今回とは被害規模が違ったためでしょう。

死亡の起算日は「3月11日」になるのが有力だそうですが、
民法第三十条では「危機が去った後」と書かれているので、
少しずれ込むかもしれません。
起算日は、遺族年金の受給のほか、
相続の開始にも影響が出てきますので重要なポイントです。
いずれにしても、6月には行方不明の方は亡くなったとされ、
遺族年金などの受給が始まりそうです。

もし生存が確認された場合は、
受給した遺族年金などは返還することになります。
誰もが行方不明の方の生存を願っていますが、
生きている方の生活再建を考慮して、
制度上、上記の流れになりつつあるということです。


最後に、「失踪宣告」に関連する、
民法の条文（三十条～三十二条）を下記に引用しておきます。
ご参考までに。

民法第三十条（失踪の宣告）
不在者の生死が七年間明らかでないときは、家庭裁判所は、利害関係人の請求により、
失踪の宣告をすることができる。
2 戦地に臨んだ者、沈没した船舶の中に在った者その他死亡の原因となるべき危難に
遭遇した者の生死が、それぞれ、戦争が止んだ後、船舶が沈没した後又はその他の危難
が去った後１年間明らかでないときも、前項と同様とする。

民法第三十一条（失踪の宣告の効力）
前条第1項の規定により失踪の宣告を受けた者は同項の期間が満了した時に、同条第2項
の規定により失踪の宣告を受けた者はその危難が去った時に、死亡したものとみなす。

民法第三十二条（失踪の宣告の取消し）
失踪者が生存すること又は前条に規定する時と異なる時に死亡したことの証明があった
ときは、家庭裁判所は、本人又は利害関係人の請求により、失踪の宣告を取り消さなけ
ればならない。この場合において、その取消しは、失踪の宣告後その取消し前に善意で
した行為の効力に影響を及ぼさない。
2 失踪の宣告によって財産を得た者は、その取消しによって権利を失う。ただし、現に
利益を受けている限度においてのみ、その財産を返還する義務を負う。
